CHI Confident Eshoo’s Provision on FOBs Will Survive Healthcare Debate

Rep. Anna Eshoo’s provision on follow-on biologics (FOBs) is one of many being considered in the healthcare reform bill. The provision would grant biologic drugs, a new class of drugs based on gene splicing and grown in living cells, 12 years of protection from competition by the generic drug industry, in addition to their patents. In an interview with the San Francisco Chronicle, CHI President and Chief Executive Officer David Gollaher, Ph.D., expressed that he believedRep. Eshoo’s provision would survive the ongoing healthcare debate. CHI advocates legislation that protects patient safety and has adequate data exclusivity periods that will incentivize companies, researchers and investors to continue to discover new treatments and cures. Industry leaders warn that shorter exclusivity periods would greatly impact venture capital investments and stifle innovation.
