CHI Statement for House Judiciary Biosimilars Hearing

On Tuesday, July 14, CHI submitted a formal statement to the House Judiciary Subcommittee on the Courts and Competition Policy for its hearing on "Biologics and Biosimilars: Balancing Incentives for Innovation." The statement, entered into the record by Congressman Darrell Issa (R-Vista), addresses the important intellectual property issues surrounding the biosimilars debate and CHI's support for legislation (HR 1548) introduced by Representatives Anna Eshoo (D-Atherton), Jay Inslee (D-WA) and Joe Barton (R-TX). It concludes that "[w]ithout adequate protection of investment through patents and/or data exclusivity, which CHI believes is best provided through H.R. 1548, fewer new biologics will be developed, effectively cutting off access to such innovations for all persons, undermining the initial concern of Congress in developing an FOB regulatory scheme. "
